IntroductionIn highly developed countries, as many as 16 percent of children are physically abused each year. Traumatic brain injury (TBI) is the most common injury in non-accidental trauma (NAT) and is responsible for 80 percent of fatal NAT cases, with most deaths occurring in children younger than three years old. Cases of abusers who refuse withdrawal of life-sustaining medical treatment (LSMT) to avoid criminal charges have previously been reported. Therefore, we hypothesized that NAT is associated with a lower risk for (...) withdrawal LSMT in pediatric TBI.MethodsThe pediatric Trauma Quality Improvement Program database was analyzed (2014 to 2016) for patients aged 16 and younger with TBI and Glasgow Coma Scale (GCS) of 8 and lower on admission. Patients with a head Abbreviated Injury Scale (AIS) of 2 or less or who died within 48 hours were excluded. A multivariable logistic regression model was used for analysis.ResultsOf 2,209 TBI patients, 92 (4.2 percent) had withdrawal of LSMT. Compared to those without withdrawal of LMST, those with LMST had statistically similar median age (three years of age versus seven years, p = 0.07) and a higher rate of NAT (33.7 percent versus 13.5 percent, p < 0.001). The most common specified perpetrator was a father/stepfather/ male partner (70 percent). After adjusting for covariates, factors associated with higher risk for withdrawal of LSMT included age of less than three years (OR 2.38, CI 1.34-4.23, p < 0.05) and NAT (OR 1.86, CI 1.02-3.41, p < 0.05).ConclusionNAT is associated with increased risk for withdrawal of LSMT in pediatric TBI. Age of less than three years is similarly associated with a higher risk for withdrawal of LSMT. Future research in this population is needed to determine what other factors predict withdrawal of LSMT and what resources, such as social workers and/or ethics consults, are utilized. (shrink)

This article offers a discussion on the opportunity of collaborative, multi-actor (public, private, science, social, and civic actors) partnerships as experimental policymaking and governance solutions for climate mitigation and adaptation plans geographically localized at the urban, metropolitan, and regional level. It sets out considerations as regards the need to design newly conceived permanent or temporary institutional geographies by building on the analysis of examples of policies implementing this kind of partnerships in Italy (e.g., river contracts; river foundations; neighborhood agreements; pacts (...) of collaboration; city science offices; urban sustainable development and innovation partnerships, etc.). Finally, the article draws attention to the challenges entailed by these partnerships including ethics, accountability, and climate justice concerns. (shrink)

Many different methodological approaches have been proposed to infer the presence of consciousness in non-human systems. In this paper, a version of the theory-heavy approach is defended. Theory-heavy approaches rely heavily on considerations from theories of consciousness to make inferences about non-human consciousness. Recently, the theory-heavy approach has been critiqued in the form of Birch's (Noûs, 56(1): 133-153, 2022) dilemma of demandingness and Shevlin's (Mind & Language, 36(2): 297-314, 2021) specificity problem. However, both challenges implicitly assume an inapt characterization of (...) the theory-heavy approach. I argue that an alternative characterization of the approach, what I call a credence-based theory-heavy approach, avoids these challenges. Theorists can generate interpretations of their theory, at different levels of generality, and operationalize these into theory-informed markers. These theory-informed are assigned a likelihood and are used to assess the probability that a target system is conscious. In providing this characterization, and mapping out the possible ways in which a credence-based theory-heavy approach can be fleshed out, the aim is to situate the theory-heavy approach as a more compelling approach than it is currently being perceived as. Our attention, then, needs to towards remaining challenges such as the consensus problem and the problem of calibrating the likelihoods associated with theory-informed markers. I also explore methodological pluralism and assess how the credence-based theory-heavy approach can benefit from other methodological approaches. (shrink)

This book represents the first monograph (miscellany) entirely devoted to Crantor of Soli (app. 335-275 BCE), an outstanding figure of the Old Academy. He was in particular famous for his On Grief, an exemplary work of consolation literature, and for his being the first commentator of Plato's Timaeus. Unlike his darling Arcesilaus of Pitane, who initiated the Sceptical turn, Crantor seems to have stuck firm to the Academic teachings of Polemon and Plato. Recent scientific research has settled on a purely descriptive definition of happiness that is focused solely on agents’ psychological states (high positive affect, low negative affect, high life satisfaction). In contrast to this understanding, recent research has suggested that the ordinary concept of happiness is also sensitive to the moral value of agents’ lives. Five studies systematically investigate and explain the impact of morality on ordinary assessments of happiness. Study 1 demonstrates that moral judgments influence assessments of happiness not only (...) for untrained participants, but also for academic researchers and even in those who study happiness specifically. Studies 2 and 3 then respectively ask whether this effect may be explained by general motivational biases or beliefs in a just world. In both cases, we find evidence against these explanations. Study 4 shows that the impact of moral judgments cannot be explained by changes in the perception of descriptive psychological states. Finally, Study 5 compares the impact of moral and non-moral value, and provides evidence that unlike non-moral value, moral value is part of the criteria that govern the ordinary concept of happiness. Taken together, these studies provide a specific explanation of how and why the ordinary concept of happiness deviates from the definition used by researchers studying happiness. (shrink)

In this paper, we challenge the usual argument which says that competition is a fair mechanism because it ranks individuals according to their relative preferences between effort and leisure. This argument, we claim, is very insufficient as a justification of fairness in competition, and we show that it does not stand up to scrutiny once various dynamic aspects of competition are taken into account. Once the sequential unfolding of competition is taken into account, competition turns out to be unfair even (...) if the usual fairness argument is upheld. We distinguish between two notions of fairness, which we call U-fairness, where 'U' stands for the 'usual' fairness notion, and S-fairness, where 'S' stands for the 'sequential' aspect of competition. The sequential unfairness of competition, we argue, comprises two usually neglected aspects connected with losses of freedom: first of all, there is an 'eclipse' of preferences in the sense that even perfectly calculating competitors do not carry out a trade-off between effort and ranking; and second, competitive dynamics leads to single-mindedness because the constraints on the competitors' choices always operate in the sense of increased competitiveness and, therefore, in the direction of an increased effort requirements. We argue (1) that competition is S-unfair even if it is U-fair, (2) that as S-unfairness increases, the ethical relevance of U-fairness itself vanishes, so that (3) by focusing as they usually do on U-fairness alone, economists neglect a deeper aspect of unfairness. This study investigates the persuasiveness of different types of expert evidence. Following Wagemans, two types of experts were distinguished that can be used in expert evidence: experiential experts and professional experts. In a between-subjects experiment, these different types of experts were included in a news report on a political issue. Results indicate that the perceived expertise and persuasiveness of professional experts was higher than that of experiential experts. Perceived expertise completely mediated the effects of the different types of expert evidence (...) on persuasion. These results point towards a recommendation of using professional expert evidence over experiential expert evidence in reporting on political issues. (shrink)

All rights reserved.We present new observations of the low-mass companion to HD 984 taken with the Gemini Planet Imager as a part of the GPI Exoplanet Survey campaign. Images of HD 984 B were obtained in the J and H bands. Combined with archival epochs from 2012 and 2014, we fit the first orbit to the companion to find an 18 au orbit with a 68% confidence interval between 14 and 28 au, an eccentricity (...) of 0.18 with a 68% confidence interval between 0.05 and 0.47, and an inclination of 119°with a 68% confidence interval between 114°and 125°. To address the considerable spectral covariance in both spectra, we present a method of splitting the spectra into low and high frequencies to analyze the spectral structure at different spatial frequencies with the proper spectral noise correlation. Using the split spectra, we compare them to known spectral types using field brown dwarf and low-mass star spectra and find a best-fit match of a field gravity M6.5 ±1.5 spectral type with a corresponding temperature of K. Photometry of the companion yields a luminosity of log=2.88 ± 0.07 dex with DUSTY models. Mass estimates, again from DUSTY models, find an age-dependent mass of 34 ±1 to 95 ±4 M Jup. These results are consistent with previous measurements of the object. (shrink)

Discutimos el problema de los "sistemas cuánticos compuestos" en la lógica cuántica así como también la interpretación de las mezclas impropias. Tomando en cuenta el desarrollo de la lógica cuántica convexa, presentamos un análisis de la estructura formal de la teoría que, argumentaremos, debe ser considerado a la hora de desarrollar un nuevo esquema conceptual para la interpretación de las mezclas cuánticas. In this (...) article, we analyze the meaning of density matrices within the formalism of quantum mechanics. We discuss the problem of compound systems in the context of quantum logic as well as the interpretation of improper mixtures. Taking into account the development of convex quantum logic, we present an analysis of the formal structure of the theory which we will argue, must be taken into account when developing a new conceptual scheme for the interpretation of quantum mixtures. There has been almost nothing written in philosophy on honesty in the past fifty years. This paper contributes one piece to a larger project of trying to change this unfortunate state of affairs. In section one, I outline an original account of the behavioural component of honesty as involving being disposed to not intentionally distort the facts as the person sees them. Section two turns to the vice of deficiency, namely dishonesty, which I suggest is the only vice corresponding to (...) honesty. It has at least five different dimensions, and a person’s character needs to be assessed along all of them before an overall judgment as to her dishonesty can justifiably be made. (shrink)

Resumo: Esse ensaio buscará sondar as relações entre filosofia e literatura, no pensamento de Gilles Deleuze, a despeito de sua parceria conjunta com Félix Guattari, atentando tanto para as concepções de escrita expressas ao longo de sua obra quanto para o modo como essas concepções teriam influenciado o estilo de seus escritos filosóficos. Partindo da premissa deleuziana de que a escrita possui um acentuado lastro clínico, sendo a responsável pela elaboração de um diagnóstico das forças capazes de aprisionar ou calar (...) a vida, procurar-se-á esmiuçar as ressonâncias desse lastro clínico, na concepção de filosofia como ato criativo, elaborada pelo autor. Como hipótese a ser aqui trabalhada, defende-se que a escrita deleuziana - compreendida como portadora de uma literalidade, conforme sustenta François Zourabchivili, ou como encrustada de uma poética imanentista, tal qual sugere Anita Costa Malufe - procuraria produzir uma zona de vizinhança ou indiscernibilidade entre a escrita filosófica, de caráter mais exegético, e a escrita literária, mais afectiva, de modo a produzir um deslocamento na relação do leitor com o ato de pensar.: In this essay we pretend to study the relationship between philosophy and literature in Gilles Deleuze’s thought, despite of his partnership with Félix Guattari, mapping the conceptions of writing throughout his work and considering the influence of these conceptions to forge a certain style in his philosophical texts. Starting from the deleuzian premise that writing has a strong clinical backing - being responsible for the elaboration of a diagnosis of the forces liable to imprison or silence life -, we will examine the resonances of this clinical backing in his conception of philosophy as a creative act. Our hypothesis is that the deleuzian writing - having a certain literality, as François Zourabchivili argues, or encrusted with an immanentism poetics, as Anita Costa Malufe suggests - would produce a so-called neighborhood zone or zone of indiscernibility between philosophical writing, with a more exegetical character, and literary writing, which is more affective, in order to produce a shift in the reader’s relationship with the act of thinking. Ob die Kategorien schon bei der Wahrnehmung eine Rolle spielen, wird von Kant-Interpreten unterschiedlich gesehen. Peter Rohs etwa argumentiert für eine Unabhängigkeit und Selbständigkeit der Wahrnehmung gegenüber dem Verstand. Die intuitive Synthesis der Einbildungskraft müsse auf eigenen Füßen stehen können und Bilder und „singuläre Sinne“ der Anwendung der Begriffe vorausgehen. McDowell hingegen spricht sich gegen eine solche Selbständigkeit der Wahrnehmung aus. Setzte man sie voraus, käme der Verstand immer zu spät . Die Argumente beider Seiten sollen am Text Kants untersucht (...) werden . Es liegt hier ein echtes Sachproblem vor. Die gegenwärtige, hauptsächlich amerikanische Diskussion um eine etwaige Notwendigkeit kognitiver Funktionen bei der Wahrnehmung stößt auf ganz ähnliche Probleme wie wir sie schon bei Kant finden, nur daß man sich dieser Ähnlichkeit außerhalb von Kantkreisen oft nicht bewußt zu sein scheint. Este artigo tem por objetivo analisar a aparente contradição entre a instituição da censura no Contrato Social de Rousseau e a censura que sofreu em Genebra e Paris. Para tanto analisaremos o conceito de censura no Contrato Social e os argumentos utilizados por Rousseau nas obras Cartas escritas da Montanha e a Carta à Christophe Beaumont, com apoio na obra de alguns comentadores da obra política de Rousseau. Nossos estudos nos levam a concluir que Jean-Jacques Rousseau admite, de fato, a (...) possibilidade da instituição da censura, no entanto, a ação dos censores deve ser restrita pela opinião pública, tal como a do príncipe em relação às leis. Além disso, se há um processo semelhante deveria atender todos os requisitos da legislação civil do Estado no qual ocorre. Tanto em Paris, como em Genebra Rousseau discorda do modo como procederam em relação às suas obras e sua pessoa. (shrink)

According to their founders, the DVjs, established in 1923, was supposed to develop a specific focus also for medieval literature and culture. This article analyzes how this program was realized and how the relationship between literary studies and intellectual history (›Geistesgeschichte‹) was shaped in different periods from the early articles of Günther Müller, Wolfgang Stammler or Walther Rehm to the reestablishment by Hugo Kuhn around 1950. The authors reconstruct a particular branch of German medieval studies still relevant today.

What is it for a person to be autonomous? Starting with a philosophical puzzle about personal autonomy and by way of critically discussing contemporary accounts, this monograph argues that AUTONOMY is a thick normative concept – the concept of a certain kind of practical authority. It then develops a conception of autonomy which solves the puzzle and offers an adequate understanding of what it means to determine oneself.

O objetivo do presente artigo é interpretar o entendimento hegeliano da liberdade no contexto do pensamento tardio de Fichte e Schelling, cuja característica é a compreensão da liberdade humana como implicação da manifestação do absoluto. Segundo a tese central do artigo, na passagem da Doutrina da Essência para a Doutrina do Conceito – que é decisiva para a Lógica de Hegel – a vinculação entre manifestação e liberdade, presente já em Fichte e Schelling, é retomada e reformulada de tal modo (...) que a efetuação da liberdade e o processo de auto-manifestação são conceitualmente identificados. Tal resultado possibilita entender a estrutura da filosofia hegeliana do direito a partir do seu fundamento lógico e, ao mesmo tempo, avaliar criticamente as leituras pragmatistas da concepção “expressivista” da liberdade de Hegel. O presente artigo tem por objetivo demonstrar como o Estado mínimo proposto por Robert Nozick invariavelmente tenderia a acabar, a menos que seus membros fossem coagidos pelo poder central a contribuir para sua manutenção. E, neste caso, obviamente violaria os direitos e liberdades que o mesmo Estado proposto pelo filósofo teria função de garantir. Analisaremos as falhas no modelo proposto por Nozick através de um viés econômico, demonstrando através da teoria dos jogos e da lógica da ação coletiva, como uma (...) organização provedora de bens públicos não-excludentes é vulnerável à atuação de free- riders, aumentando assim os custos de sua atuação, e diminuindo os incentivos para sua existência. In diesen Artikel wird Amartya Sen als Theoretiker der Freiheit dargestellt, dessen Ansatz dem Kommunitarismus gegenüber stärker aufgeschlossen ist als andere liberale Theorien. Das gilt zumindest für einen Kommunitarismus, der Freiheitsrechten einen zentralen Stellenwert einräumt. Sen selbst hat sich allerdings nicht stark mit dem Kommunitarismus auseinandergesetzt und diesen nur vereinzelt in seiner antiliberalen Variante kritisiert. Demgegenüber zeigt dieser Text, dass das Freiheitsverständnis von Sen einen Gemeinschafts- und Wertebezug beinhaltet, der sich mit den Anliegen vieler Kommunitarier deckt.

Relative poverty and absolute poverty are often seen to be very distinct concepts and seldom discussed together. While absolute poverty is seen to be about existential threats, relative poverty is understood to be about economic inequality only. One is an issue of basic rights then and the other a question of justice or fairness. But in this picture it becomes incomprehensible why the same concept is used for so different issues. This article tries to show that relative and absolute poverty (...) do have something very important in common. Both concepts are about not having enough goods in order to be able to life a decent life, i.e. a life in dignity. While absolute poverty indicates that someone does not have enough goods to live a decent life under any circumstances, relative poverty indicates that someone does not have enough goods to live a decent life in a given society. So understood poverty in both cases is a violation of human dignity. (shrink)

Cet article réexamine la totalité des témoignages sur la pensée démocritéenne de l’origine du culte divin. Une étude approfondie de ces témoignages nous autorise à affirmer que, dans l’esprit de Démocrite, le culte des dieux ne dérivait pas seulement d’une peur des phénomènes naturels hostiles, mais aussi de la reconnaissance pour les événements favorables à la survie des humains. Il est à présent possible de réinterpréter cette conception selon un point de vue polémique : Démocrite n’aurait pas nié l’existence des (...) dieux, mais plutôt exposé les mécanismes psychologiques qui conduisent les hommes ordinaires à croire dans les dieux traditionnels. Contre la croyance superstitieuse, il démontre, en s’aidant également de la théorie des εἴδωλα, que les seuls dieux qui existent sont pourvus de la même « raison » que celle à l’œuvre dans la nature et grâce à laquelle les hommes peuvent comprendre ses phénomènes aussi suprenants que variés. Les philosophes, disait Robert Musil, sont des êtres violents qui, faute d'avoir une armée à leur disposition, se soumettent le monde en l'enfermant dans un système. Il peut aussi leur arriver de vouloir atteindre leurs objectifs en devenant les conseillers d'un prince. Ils s'exposent, en ce cas, à de pénibles frustrations, car le prince (" bon " roi ou " méchant " tyran) n'a que faire des conseils d'un naïf philosophe. Si je reviens ici sur les temps forts de cette (...) histoire (Platon et Denys, Descartes et Christine, Voltaire et Frédéric, Heidegger et Hitler, etc.), ce n'est pas pour inviter les philosophes à s'éloigner de la politique. C'est, au contraire, pour tenter d'instituer, entre le pouvoir et la pensée, un véritable dialogue.
